Welcome to Moire. These Terms of Service ("Terms") govern your access to and use of Moire's AI-powered fashion design platform, including our website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

You must be at least 16 years old to use our Services. By using Moire, you represent and warrant that you meet this age requirement.

2. Description of Services

Moire provides an AI-powered fashion design platform that allows users to:

  • Generate fashion design images using artificial intelligence
  • Access curated fashion techniques and garment expertise for enhanced prompts
  • Save and organize generated designs in a portfolio
  • Download and use generated images according to these Terms

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Security

You are responsible for safeguarding your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscription Plans and Credits

4.1 Free Tier

  • New users receive 10 free generations upon registration
  • Free tier credits do not expire
  • Free tier includes standard generation features
  • Watermarks may be applied to free tier generations

4.2 Paid Subscriptions

  • Starter ($19/month): 200 generations/month, standard features, no watermarks
  • Professional ($49/month): 700 generations/month, standard features, no watermarks
  • Studio ($149/month): 2,500 generations/month, standard features, no watermarks

4.3 Credit System

  • Subscription credits refresh monthly on your billing date
  • Unused subscription credits expire at the end of each billing period and do not roll over
  • Additional credit packs may be purchased separately
  • Purchased credit packs expire 12 months from purchase date
  • Credits are non-transferable between accounts

4.4 Billing and Payments

  • All payments are processed securely through Stripe
  • Subscriptions automatically renew unless cancelled
  • You authorize us to charge your payment method on file
  • Prices are subject to change with 30 days notice
  • All fees are exclusive of applicable taxes

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of the prompts you submit and the images generated from your prompts, subject to the following:

  • You grant us a limited license to process your prompts for service delivery
  • Generated images may be used for your personal and commercial purposes (paid tiers only for commercial use)
  • You are responsible for ensuring your prompts do not infringe third-party rights

5.2 Commercial Use Rights

  • Free tier: Personal, non-commercial use only
  • Paid tiers: Full commercial rights to generated images
  • Attribution to Moire is appreciated but not required for paid users

5.3 Our Intellectual Property

Moire and its licensors retain all rights to:

  • The Moire platform, software, and technology
  • Our fashion techniques database and curated datasets
  • Trademarks, logos, and brand elements
  • Documentation and educational content

5.4 AI-Generated Content Disclaimer

Images generated by AI may inadvertently resemble existing designs, artworks, or copyrighted materials. You acknowledge that:

  • AI outputs are probabilistic and may produce similar results for similar prompts
  • We do not guarantee that generated images are unique or free from resemblance to existing works
  • You are responsible for reviewing generated content before commercial use
  • Technical accuracy of fashion-related generations is not guaranteed

6. Acceptable Use Policy

6.1 Prohibited Content

You may not use our Services to generate, upload, or distribute:

  • Illegal content: Material that violates any applicable law
  • Harmful content: Content promoting violence, hatred, or discrimination
  • Adult content: Sexually explicit or pornographic material
  • Deceptive content: Deepfakes, misinformation, or fraudulent material
  • Infringing content: Material that violates intellectual property rights
  • Private information: Personal data without consent

6.2 Prohibited Activities

You may not:

  • Attempt to reverse engineer, decompile, or extract our AI models
  • Use automated systems to access our Services beyond normal use
  • Resell, sublicense, or redistribute access to our Services
  • Circumvent usage limits, authentication, or security measures
  • Interfere with or disrupt the integrity of our Services
  • Create competing AI services using our platform or outputs
  • Share account credentials or allow unauthorized access

6.3 Fair Use Limits

To ensure service quality for all users, we may impose:

  • Rate limits on API calls and generations
  • Maximum generations per day (10 for free, unlimited for paid)
  • Concurrent generation limits
  • Storage limits for saved designs

7. Termination

7.1 Termination by You

You may cancel your subscription or delete your account at any time through your account settings or by contacting us. Upon cancellation:

  • Subscription access continues until the end of your billing period
  • Unused credits are forfeited and not refundable (see Refund Policy)
  • You may download your generated images before deletion

7.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activity
  • Fail to pay fees when due
  • Abuse our Services or support resources

We will provide notice when possible, except in cases of severe violations requiring immediate action.

8. Disclaimers

8.1 Service Availability

Our Services are provided "as is" and "as available." We do not guarantee:

  • Uninterrupted or error-free service
  • Specific results or outcomes from generations
  • Compatibility with all devices or browsers
  • Preservation of all data in case of service issues

8.2 AI Limitations

You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or unexpected results
  • Fashion techniques information is provided for creative inspiration, not as technical specifications
  • Generation quality may vary based on prompts, demand, and system factors
  • We continuously improve our models, which may affect generation characteristics

8.3 No Professional Advice

Our Services do not constitute professional fashion, design, legal, or business advice. Generated content should be reviewed and validated before use in professional contexts.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not liable for damages arising from your use of generated content
  • We are not liable for third-party actions or content

10. Indemnification

You agree to indemnify and hold harmless Moire, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate, upload, or distribute

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at [email protected] to attempt informal resolution. We will work in good faith to resolve disputes within 30 days.

11.2 Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

11.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with ICC Rules (International Chamber of Commerce). Class action waivers apply to the extent permitted by law.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending email notification for significant changes

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using our Services.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Moire.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

13.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

13.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
